It can happen in an instant: your life is shattered because someone else caused an accident that resulted in catastrophic injuries or the tragic loss of life of someone you love.  Your life changes because of someone elses’ carelessness and negligence and now the insurance company wants to blame you! You are left wondering: who will pay my medical bills?  My loss of income?  Am I entitled to pain and suffering or other damages for all I have been through?  The short answer:  yes you are.

The worst part of being injured by someone elses’ carelessness is often not knowing what to do and how to protect your rights in a complex legal system.  Insurance companies have lawyers to protect their corporate interests and that is why you need your own lawyer to protect your rights.

Maryland law defines an accident as “an event that takes place without one’s foresight or expectation; an event which proceeds from an unknown cause, or is an unusual effect from a known cause, and therefore not expected.”

The problem with the word “accident” is that it implies a forgivable offense — an honest mistake was made, and we are taught from a very young age that we forgive others for their mistakes.  Insurance companies now even offer “accident forgiveness” insurance, but if you have a wreck, you will probably lose your safe driver discount.

The truth is, however, that insurance companies don’t let people off the hook for their “mistakes.”  They do not really “forgive” drivers who cause accidents — they may charge higher rates for other types of coverage or the insurer may deny policyholders future coverage altogether — therefore you should not let the insurance company off the hook by accepting an unfair settlement offer.

In motor vehicle collisions, most crashes are caused by choices made by the driver at fault.  For example,  speeding and reckless driving are both dangerous and illegal acts and are choices a driver makes.  Tailgating, road rage, driving under the influence, are also choices people make.  Using a cell phone or texting while driving is also a choice that can have deadly consequences.  These choices are not “accidents”, but careless or negligent behavior that can lead to crashes that injure or take the lives of innocent people.

One of the reasons it is important to understand “negligence” is because Maryland’s highest court ruled that accident victims cannot recover damages from an injury in a negligence case if they are found to be partly at fault.  That is why insurance companies often attempt to blame victims — to avoid paying on claims.  That is just one of the many reasons why you need a lawyer if you have been seriously injured in an “accident” that was caused by someone else.
